Dr. Paul Thomas, an Oregon pediatrician, was stripped of his medical license in 2020 when the Oregon Medical Board made the ridiculously illogical judgment that he was putting his patients in “immediate danger” by providing informed consent about vaccination. Dr. Thomas sued the medical board, lost his appeal, and asked for a hearing before the U.S. Supreme Court. ICAN submitted a Brief of Amicus Curiae in support of Dr. Thomas.  Unfortunately, the Supreme Court declined to hear his case, and it is clear that a renewed push for informed consent is needed now more than ever.

Dr. Thomas is well-known for his book The Vaccine-Friendly Plan and the study he published (later baselessly retracted) in 2020 on the health outcomes of thousands of vaccinated vs. unvaccinated children in his own practice. He concluded that the vaccinated children in his practice “appear to be significantly less healthy than the unvaccinated.”

ICAN’s brief explained that Dr. Thomas had his license removed for “providing information to patients in a manner that deviates, apparently even slightly, from government-endorsed speech such that it fails to produce the results the board demands, which is more vaccination.” ICAN went on to note that that, without intervention, the lower court’s decision would “only serve to invite, if not demand, the further erosion of Americans’ judicially recognized right to truly informed consent to medical procedures.”

Regardless of the differing opinions Americans have about vaccines, our Constitution’s First Amendment gives all doctors the right to tell patients about the risks and benefits of vaccination. As ICAN stated in its submission to the court, by allowing this decision to stand, the federal courts are essentially enabling “the delicensing of physicians for doing nothing more than deviating from CDC guidelines” and deterring them from giving patients the unvarnished truth about medical procedures.

As a longtime ally of Dr. Thomas, ICAN is outraged by the ongoing censorship of medical professionals. ICAN will continue to stand by doctors like Thomas and protect their Constitutional right—and moral imperative—to provide informed consent to patients. Dr. Thomas’s fight isn’t over and ICAN intends to support him in any way we can. You can stay informed at PaulThomasMD.com. You can read ICAN’s amicus brief in its entirety here.
